Starting the Divorce Process

Here in Doylestown, there are many reasons why couples file for divorce in January. From an emotional perspective, some people want to get through the holiday season before making any big announcements or decisions, while others want to use the new year for a fresh start. From a practical perspective, January can be a good time because it allows you to have a full collection of year-end documents with which to move forward. And from a financial perspective, waiting until January ensures that any year-end bonuses that were paid in December will be included as part of the marital property.

Regardless of when you file for divorce, it is important to be prepared. For starters, you will need a plan for living arrangements. Who will move out? Where will they go? You should also begin the process of separating your finances by opening bank accounts in your own name.

Additionally, you will need to gather a good deal of information in advance of filing for divorce. Financial records will determine your support and asset division, so the more information you have the better. Here is a short list of some of the paperwork and records you will want to have on hand.

  • Recent tax returns – these will include a lot of the important financial information that you will need in relation to income and assets.
  • Pre or post-nuptial documentation.
  • Any relevant business agreements.
  • Wills and documents relating to any trusts.
  • Debt records – including credit card balances, mortgage statements, and other loans.
  • Asset listings – information about any jointly owned property, assets and investments.
  • An estimated household budget – compiled using your end-of-year billing statements.

January is a time of fresh starts and new beginnings. If you made the commitment to move forward with your life, there is still time. To get your new life off to the best start, you should begin the divorce process with thorough preparation and a commitment to a peaceful resolution. As a trained mediator, I am prepared to help you through a tumultuous time with calm decision making and thoughtful problem solving.
